Terms of Service

1. Acceptance of Terms

By accessing or using Forja ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. We reserve the right to update these terms at any time, and continued use after changes constitutes acceptance of the modified terms.

2. Account Registration

You must be at least 13 years of age to create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during registration. One person may not maintain more than one account. We reserve the right to suspend or terminate accounts that violate these terms.

3. Seller Responsibilities

As a seller on the Platform, you represent and warrant that:

• You are the original creator of the content, or you hold all rights and licenses necessary to sell and distribute it
• Your products do not infringe on any third-party intellectual property rights, including copyrights, trademarks, characters, logos, brand names, or designs owned by others
• You have obtained any permission required for content that depicts or is derived from third-party franchises, brands, vehicles, or trademarks, and you accept sole responsibility for such content
• Your products are compatible with Roblox Studio and function as described
• You will respond to buyer inquiries in a timely manner
• You will not upload malicious code, viruses, or backdoors
• You will accurately describe your products, including compatibility and limitations
• You comply with Roblox's Terms of Use and Community Standards

These representations are ongoing. If you cannot make them for a given item, do not list it. Listing content in violation of this section may result in removal of the item, forfeiture of associated proceeds, and termination of your account.

4. Buyer Rights

Upon completing a purchase, buyers receive a non-exclusive, non-transferable license to use the purchased asset in their Roblox projects. Buyers may not redistribute, resell, or share purchased assets. Buyers may use purchased assets in unlimited personal Roblox projects unless otherwise specified by the seller. Access to purchased assets is maintained through your account library.

5. Prohibited Content

The following content is strictly prohibited on the Platform:

• Content that infringes on intellectual property rights
• Malicious scripts, exploits, or cheating tools
• Content that violates Roblox's Terms of Use
• Sexually explicit, violent, or hateful content
• Assets containing personal information of others
• Misleading or fraudulent product descriptions
• Stolen or unauthorized copies of other creators' work

6. Intellectual Property

Sellers retain all intellectual property rights to their uploaded content. By uploading content to the Platform, you grant Forja a non-exclusive, worldwide license to display, distribute, and promote your content on the Platform. The Forja name, logo, and platform design are the property of Forja and may not be used without permission.

Forja acts solely as a venue connecting buyers and sellers. We do not create, own, endorse, or independently verify the ownership of seller-listed content, and we make no representation that any listed item is free of third-party claims.

7. Copyright Complaints & Repeat Infringers

We respect intellectual property rights and respond to valid infringement notices. If you believe content on the Platform infringes your rights, submit a report through our DMCA page, including identification of the work, the location of the allegedly infringing item, your contact details, and a statement made in good faith.

We may remove or disable access to reported content, in whole or in part, at our discretion and without prior notice. Sellers may submit a counter-notice if they believe removal was in error. We maintain a repeat infringer policy: accounts that are the subject of repeated valid infringement notices will be terminated, and associated listings removed.

8. Indemnification

You agree to defend, indemnify, and hold harmless Forja, its operators, employees, and affiliates from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) content you upload, list, sell, or distribute through the Platform; (b) any allegation that such content infringes or misappropriates the intellectual property, trademark, publicity, or other rights of a third party; (c) your breach of these Terms or of your representations under Section 3; or (d) your violation of any applicable law or of Roblox's Terms of Use.

This obligation survives termination of your account. We reserve the right to assume the exclusive defense of any matter subject to indemnification, at your expense, in which case you agree to cooperate with our defense of that claim.

9. Relationship to Roblox

Forja is an independent platform. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with Roblox Corporation. "Roblox" and related marks are the property of Roblox Corporation. Transactions on Forja are for creator-made asset files exchanged off-platform and are not sales of Roblox items, Robux, accounts, or in-experience content. You are responsible for ensuring your use of any purchased asset complies with Roblox's Terms of Use and Community Standards.

10. Payment Terms

All payments are processed through Stripe Connect. Sellers receive payment minus the platform fee (10% on the Free plan, reduced on higher-tier plans) and Stripe processing fees (approximately 2.9% + $0.30 per transaction). Payouts are made directly to your connected Stripe account. Prices are listed in USD. Sellers are responsible for any applicable taxes on their earnings.

11. Refund Policy

Due to the digital nature of products sold on the Platform, all sales are generally final. Buyers may file a dispute within 14 days of purchase if the product is materially different from its description, does not function as advertised, or contains malicious content. Refund decisions are made at the sole discretion of Forja. See our Refund Policy for full details.

12. Account Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, sellers will receive payment for any completed, non-disputed orders. Buyers retain access to previously purchased assets.

13. Limitation of Liability

Forja is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the fees paid to us in the 12 months preceding the claim. We are not responsible for the quality, safety, or legality of products listed by sellers.

14. Dispute Resolution

Disputes between buyers and sellers will first be mediated by Forja through our support system. If mediation fails, disputes shall be resolved through binding arbitration in accordance with applicable law. You agree to attempt resolution through our platform before pursuing legal action.
